THE COMMUNITY

(Comunidad de Propietarios)

 

This section is intended to assist owners in understanding their rights and obligations as members of the community, how to participate actively in the community both at the annual general meeting and otherwise, how to understand the decision making process, the problems that arise from time to time, the importance of communication between owners and their appointed representatives and also the rights that you have.  

 

Owning an apartment at La Torre de Andalucia makes you a member of a community of property owners.  You will find that yourself and your apartment are affected by the community and the decisions of the members of the community.  Community feesare due to the community twice each year and you are entitled to meet with your fellow owners every year at the annual general meeting to decide on matters relating to the community, the building and its administration.  

 

Decisions regarding administration of the community are vitally important as they involve the planning of budgets, approval of accounts and future expenditure.

 

The Law

 

The Community of Property (Comunidad de Propietarios) is the organisation that conducts the regulation and administration of the joint ownership of common property.  The Torre building contains communal areas such as the stairs, service areas, the lobby and reception areas, the administrative areas and offices right down to the meeting room where the annual general meeting takes place.  The community is responsible for maintenance of the lift, the upkeep of the swimming pool and the gardens, employment of the administration staff, and general maintenance such as the exterior of the building, the balconies and the roof area.  

 

The owners must decide how to pay for the maintenance and management of the property, how much money to set aside and prove expenditure on an annual basis and make provision for substantial expenditure that may occur from time to time in such a large community.  This whole process is subject to statutory regulation, codified by the law of horizontal property (La Ley Propiedad Horizontal), perhaps an unusual description for a law that relates for the most part, as in our case, to vertical buildings.  

 

Contributions

 

Appropriate suggestions and comments regarding the community as a whole (from members of the community) will be collated and we will put to them to the President and Executive Committee and invite a response.  If you wish we will treat such contributions as anonymous.
